Welcome to Trifundit! By accessing or using our website or app, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully. If you do not agree with any part of these Terms, you should not use our services.
1. Introduction and Acceptance
These Terms constitute a legally binding agreement between you ("User," "Sponsor," "Athlete," "Charity," or "you") and Trifundit ("we," "us," or "our"), governing your use of our platform, services, and tools (collectively, the "Services"). By creating an account or otherwise accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. Platform Purpose and Role
Trifundit provides a platform for individuals and organizations to create and participate in fundraising activities for charitable purposes. We act as a facilitator between donors and charities and are not a party to any transactions, agreements, or donations made through the platform.
3. User Responsibilities
By using Trifundit, you agree to:
- Represent and Warrant: You represent and warrant that all information you provide about yourself or your charity is true, accurate, and complete. You are responsible for updating this information to maintain its accuracy.
- Use for Lawful Purposes: You agree to use the platform in compliance with all applicable laws and regulations and in alignment with our mission to support charitable causes.
- Prohibited Activities: You will not use the platform for any unlawful or fraudulent activity, misrepresentation, or activities that may harm the reputation of Trifundit or its users. This includes, but is not limited to, money laundering, financing terrorism, or soliciting funds for non-charitable purposes.
4. Charity and Fundraiser Requirements
Charities using the platform must:
- Alignment with Mission: Ensure that their campaigns and activities align with the charitable purposes and values of Trifundit.
- Authorization to Collect Funds: Charities must have all necessary approvals and authorizations to solicit and collect donations, and Raisers must have permission from the designated charity to fundraise on their behalf.
- Compliance: Comply with all applicable laws, including any registration or reporting requirements imposed by governing authorities.
5. Payment Processing and Giving Fund
- Payment Methods: Trifundit partners with third-party payment processors to handle all financial transactions. By using our platform, you agree to the terms and conditions of these third-party providers. Trifundit is not responsible for the performance of these processors.
- TriFundit Giving Fund Participation: In certain scenarios, donations may be routed through the nonprofit TriFundit Giving Fund for processing and distribution to the designated charities. By donating, you acknowledge and agree that the TriFundit Giving Fund may be used in this manner.
- Chargebacks and Refunds: Donations are generally non-refundable. Any disputes, chargebacks, or refund requests are subject to our policies and the policies of our third-party payment processors. Trifundit reserves the right to deduct fees associated with chargebacks or refunds from the amount received by the charity.
6. Content and Intellectual Property
- Platform Content: All materials provided by Trifundit, including text, graphics, logos, and software, are protected by intellectual property laws. You may not use, copy, reproduce, or distribute our content without our prior written consent.
7. Limitation of Liability
To the fullest extent permitted by law, Trifundit, its affiliates, partners, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the platform or services. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses.
8. Indemnification
You agree to indemnify, defend, and hold harmless Trifundit, its affiliates, partners, employees, and agents from any and all claims, liabilities, damages, losses, or expenses, including reasonable attorney's fees, arising from your use of the platform, violation of these Terms, or infringement of any third-party rights.
9. Dispute Resolution
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of laws principles. Any disputes arising out of or relating to these Terms or the use of the platform shall be resolved through binding arbitration, which will take place in West Palm Beach, Florida.
- Waiver of Class Actions: You waive any right to participate in class actions, class arbitrations, or representative actions as part of this agreement.
10. Modification and Termination
- Changes to Terms: We reserve the right to modify these Terms at any time. We will notify you of any significant changes by posting the updated Terms on our website/app. Your continued use of the platform following any changes constitutes acceptance of the revised Terms.
- Termination: We may terminate or suspend your access to the platform at our sole discretion, without prior notice, if we believe you have violated these Terms or engaged in any conduct harmful to Trifundit or its users.
11. Miscellaneous
- Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
- Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and Trifundit regarding your use of the platform.
